A growing number of judicial nominees are refusing to affirm basic facts about the 2020 election, and this trend is alarming business leaders and senators alike. When candidates for lifetime federal judgeships cannot or will not acknowledge that a free and fair election took place, they undermine the very foundation of judicial independence. The courts rely on public trust, and that trust erodes when judges appear to treat political narratives as more important than established evidence.
For the business community, this is not an abstract concern. Economic stability depends on predictable legal outcomes. Companies make investment decisions, sign contracts, and plan expansions based on the assumption that courts will apply the law consistently, without partisan bias. If judges are selected based on their willingness to indulge election falsehoods, the rule of law becomes a political tool rather than a neutral arbiter. That uncertainty raises costs and discourages long-term economic activity.
Senators who vote on confirmations have a responsibility to demand that nominees respect factual reality. Refusing to affirm the outcome of a democratic election should be a disqualifying trait, not a minor disagreement. The integrity of the judiciary and the health of the economy both depend on judges who put truth above party loyalty. Confirmation must require a basic commitment to facts, or the courts will lose the credibility they need to function.
