A new Texas ban on the manufacture and sale of smokable hemp products is facing immediate resistance from the industry, with business owners reporting significant financial losses and a lawsuit now challenging the state's authority to enact the rules.
The ban, which took effect recently, prohibits the processing and retail of all smokable hemp flowers and pre-rolls. For many retailers, these products represented a substantial portion of their revenue. Shop owners across the state describe a sudden, sharp drop in sales, forcing difficult decisions about inventory and staffing. They argue the state is destroying a legitimate market created by the 2018 Farm Bill and the subsequent legalization of hemp in Texas.
In direct response to the economic impact, a coalition of hemp companies has filed a lawsuit against the Texas Department of State Health Services. The plaintiffs contend that the state legislature overstepped its authority by banning a federally legal agricultural commodity. They assert the rules unfairly target a specific segment of the hemp industry while allowing other forms, like edible CBD products, to remain on the market.
The state maintains the law is a necessary measure for public safety, aiming to aid law enforcement in distinguishing between legal hemp and illegal marijuana based on smell and sight alone. As the legal battle begins, Texas hemp businesses face an uncertain future, caught between state prohibition and a federal green light.
